February 19 - Last week Swaziland-based Internet casino, Piggs Peak online casino,
was successfully granted permission to appeal a South African High
Court ruling made in November last year in Pretoria.
The 'case that caused all the trouble' began in 2003 when Piggs Peak launched a
lengthy court action with the objective of seeking a declaratory judgement that its
online gambling operations in South Africa were legal.
At the foundation of the action were Piggs Peak's claims that the online casino
should be allowed to operate legally in South Africa on account of its online
gambling servers being hosted in Swaziland, where online gambling is legal, licensed
and regulated.
Judge W. Hartzenberg of the Pretoria High Court disagreed, citing
that in his opinion Casino Enterprises, which owns and operates Piggs Peak
online casino, did not disclose a valid reason for approaching him for the court
order.
Casino Enterprises responded with an application made on December 7th last year
to appeal Hartzenberg's ruling. The judge gave the company until December 15th
to redraft its application to declare its South African online gambling
operation legal.
With permission granted to proceed with the appeal, a date has yet to be
allocated for the matter to be heard before the Supreme Court of Appeals in
Bloemfontein.
In the mean time, the South African Cabinet has approved a Draft Gambling
Amendment Bill to regulate online gambling as well as cell phone gambling which
is fantastic news for South African online casino fans.
